By creating an account, purchasing a plan, or using the Service, you agree to these Terms. If you don’t agree, do not use the Service.

1) Accounts & Eligibility

• You must be at least 18 and able to form a contract.
• Keep your login secure; you’re responsible for all activity under your account.
• Business users must ensure all users comply with these Terms.

2) Plans, Billing & Renewals

• Plans: TINT, PPF, and PRO (TINT + PPF), offered on Monthly or Annual subscriptions.
• Subscriptions renew automatically until canceled. You can cancel anytime in-app; access remains through the end of the paid term.
• Fees are shown at checkout and may be subject to taxes. Payments are processed by our third-party processor; we don’t store full card data.
• Trials/promotions (e.g., 5-day demo) convert to paid unless canceled before the trial ends.

3) License & Acceptable Use

• We grant you a limited, non-exclusive, non-transferable license to install and use SharpCut™ for your internal business use during your active subscription.
• You may not:
  • copy, resell, sublicense, or distribute the software or template files outside your organization;
  • reverse engineer, decompile, or bypass technical protections;
  • scrape or bulk-export templates;
  • use the Service for unlawful purposes or to infringe third-party rights;
  • share credentials outside your team or exceed purchased seats.
• We may suspend or terminate accounts that violate these Terms.

4) Content, Templates & Updates

• The Service includes a library of cutting patterns/templates that auto-sync. Availability can change; not all makes/years/variants are guaranteed.
• You’re responsible for verifying fitment and safe use before cutting.
• We may deliver automatic updates, fixes, or changes without notice.

5) Hardware & Third-Party Services

• SharpCut™ is designed to work with a wide range of plotters; actual compatibility may vary by model, firmware, and settings.
• Third-party services (payments, analytics, support) are subject to their own terms; we’re not responsible for their performance.

6) Intellectual Property

• EVOLV and its licensors own SharpCut™, the site, documentation, and all related IP.
• Trademarks, logos, and brand names are the property of their respective owners and used for identification only.

7) Support

• Standard support is provided to active subscribers via the channels listed on the site. Response times may vary by plan and workload.

8) Disclaimers

• THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• We do not warrant uninterrupted or error-free operation, universal compatibility, or that templates will meet every specific job requirement.

9) Limitation of Liability

• TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVOLV AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL.
• Our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid to EVOLV for the Service during the 12 months before the claim.

10) Indemnity

• You agree to indemnify and hold EVOLV harmless from claims arising out of your misuse of the Service, violation of laws, or infringement of third-party rights.

11) Termination

• You may stop using the Service at any time. We may terminate or suspend access for breach of these Terms or for legal/security reasons. Upon termination, your license ends and you must stop using the software.

12) Changes to Terms

• We may update these Terms from time to time. The “Effective date” will change; continued use after changes means you accept the updated Terms.

13) Governing Law & Disputes

• These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
• Venue and jurisdiction lie in the state or federal courts located in Broward County, Florida, unless otherwise required by law.
• You and EVOLV waive jury trial to the extent permitted by law.

14) Privacy

• Your use is also subject to our Privacy Policy (posted on the site), which explains what we collect and how we use it.
